This collection is about how law makes meaning and how meaning makes law. Through clear methodology and substantial findings, chapters expose the deficits of 'literal' meaning and the difficulties in 'ordinary' meaning, in international legal contexts and in more immediate social ones, as well as in courtrooms. In this provocative work, Frances E. Gill argues that self-determination is a universal goal of correctional counseling. Gill leads the reader through a rigorous philosophical justification of the paternalism of state punishment in service of this goal.

This essay argues that John Stuart Mill is not the radical anti-censorship thinker he is sometimes supposed to be. By describing a contemporary case ofa journalist who denied the holocaust, I show that there is evidence in Mill that supports the position that the journalist should have been censored.

InThe Moral Dimension, Amitai Etzioni critiques the neoclassical economic paradigm (NEP), a model built upon ethical egoism and which equates rationality (the logical/empirical domain) with the maximization of preferences by self-interested economic units. Etzioni finds the NEP’s exclusion of the moral/affective domain to be a glaring failure and, because of this omission, he claims that the economic model is not capable of achieving its design functions: prediction and explanation. Etzioni introduces a socio-economic model, the I & We paradigm, in which (...) the moral/affective encapsulates the logical/empirical. Further elaboration and testing of this model remains to be undertaken. We find it to hold more promise than its neoclassical economic rival, and we explicate its value for the modern manager. Taking a Stand in a Postfeminist World offers an engaged cultural criticism in a postfeminist context.

Existing arguments against paid organ donation are examined and found to be unconvincing. It is argued that the real reason why organ sale is generally thought to be wrong is that (a) bodily integrity is highly valued and (b) the removal of healthy organs constitutes a violation of this integrity. Both sale and (free) donation involve a violation of bodily integrity. In the case of the latter, though, the disvalue of the violation is typically outweighed by the presence of other (...) goods: chiefly, the extreme altruism involved in the giving. There is usually no such outweighing feature in the case of the former. Given this, the idea that we value bodily integrity can help to account for the perceived moral difference between sale and free donation. (shrink)

A common occurrence in television news is the showing of graphic scenes of human suffering. It was hypothesized that viewing such scenes could be harmful to a segment of the population. A controlled experiment examined the impact of images showing victim blood inserted into into television news stories about auto accidents. The amount of blood shown was manipulated, resulting in three video versions, roughly in terms of low, medium, and high. Participants were measured beforehand on the variable of "locus of (...) control" and randomly assigned to one of the three treatment groups. Dependent variables included emotional impact and mean world syndrome. The results suggested blood shown on screen makes a difference in the perceived emotional impact of the story. Locus of control was found to be linked to mean world syndrome. The findings suggest that the quest for hardhitting news and high ratings must be tempered with the knowledge that some viewers are adversely affected by these graphic scenes of human suffering. Recent developments in the business world have caused the academic community to address the coverage of ethics in the accounting curriculum. This study surveyed accounting faculty to: (1) examine perceptions about ethics coverage in the undergraduate accounting courses; (2) identify teaching methods used to include ethics in the undergraduate accounting courses, the perceived effectiveness of those methods and the amount of time spent on ethics coverage; and (3) to identify problems encountered in including ethics in accounting courses. The study found (...) that although a large majority of the professors surveyed (77%) said they include ethics, 69% felt that there was a need for more ethics coverage. Also, the study revealed that while the lecture method was the most commonly used method, the written case was deemed the most effective method. The average time spent covering ethics was a little over 3 hours per course. The most significant problems encountered by faculty who include ethics in their undergraduate accounting courses was not enough time and lack of appropriate ethics materials. (shrink)
